The Iowa Supreme Court in an historic
decision filed December 22, 1982 adopte
the doctrine of comparative negligence for
Iowa. By a 5 to 4 vote the high court
abandoned the doctrine that the contributory
negligence of a party is a bar to recovery.
The form of the doctrine of comparative
negligence is believed to be that which is
commonly known as pure comparative in
that the court stated -  * * recovery is
not barred unless the injured party's neg-
ligence is the sole proximate cause of
the damages.
The majority opinion written by Justice
Mark McCormick makes the decision ret-
roactive by holding that * * * the doc-
trine shall apply to (1) the present case, (2)
all cases tried or retired after the date of
filing this opinion, and (3) all pending cases,
including appeals, in which the issue has
been preserved.
The Association will conduct three region-
al comparative negligence seminars on Jan-
uary 26, 27, and 28, 1983 at Sioux City, Des
Moines and Cedar Rapids respectively The
seminar panelists will examine the many
unanswered questions generated by the
opinion. Every effort is being made to pro-
vide the seminar attendees with up to date
data on how the questions raised and issues
presented by the opinion have been an-
swered in other jurisdictions which have
some form of comparative negligence.

The 1983 Bridge-The-Gap Committee
under the Young Lawyers Section of the
Iowa State Bar Association proudly an-
nounces the 15th Annual Bridge-The-Gap
Seminar and invites you to attend the
sessions.
This is the first year that the program
has included all fifteen hours of the Iowa
C.L.E. requirements. As part thereof, the
six hours of Federal C.L.E. requirements
will be included. Hence, you can meet both
your State and Federal C.L.E. require-
ments by attending this one seminar
This year the seminar will start on

conclude on Friday afternoon, April 29,

SELECTION OF A JURY -
PLAINTIFF'S VS. DEFENDANT'S
VIEWPOINT:          Charles T Traw
Richard G. Santi
Mr Traw and Mr Santi will select a jury
from a panel of eight prospective jurors.
Judge Louis A. Lavorato will preside over
the selection of the jurors. The attorneys will
deal with the geography of jury selection,
projecting the fairness of their positions to
the jury and how to respond to the silent
voice in the jury room. After the selection of

will be available in an adjunct room in
order to accommodate any overflow
crowd, thereby eliminating the close quar-
ters of the past. As with last year, seating
will be at tables for your convenience.

hundred rooms for advance reservations.
Those staying at the Hotel Savery will
have access to their health spa which
includes complete exercise equipment -
jogging track - sauna - steam inhalation
and sun rooms - whirlpool - masseur -
lounge with TV. and vibrating chairs.

Judge Lavorato will cover what the Trial
Court ordinarily expects by way of re-
quested instructions, how to make a record
on instructions and the use of instructions in
final argument.
