Legislative Program Underway As heretofore reported in THE NEWS BUL- LEIrN, the Iowa State Bar Association is spon- soring in the General Assembly a bill to change section 638.23, Code 1954, relative to com- pensation for executors, administrators and their attorneys. The present law In Iowa i elative to compen- sation for executors, administrators and their attorneys was enacted in 1919 and since that time, 38 years ago, no changes have been made. The present law reads as follows: 638.23 Compensation. Executors and ad- ministrators shall be allowed such reasonable fee as may be determined by the court, for services rendered, but not in excess of the fol- lowing commissions upon the personal estate sold or distributed by them and for the pro- ceeds of real estate sold for the payment of debts by them which shall be received as full compensation for all ordinary services: For the first one thousand dollars, six per cent For the overplus between one and five thou- sand dollars, four per cent. For all sums over five thousand dollars, two percent. The bill to be presented by the Iowa State Bar Association, after two years of intensive study, by the Special Committee on Improve- ment of the Economic Condition of the Bar and the Legislative Committee, and with the unanimous approval of the Board of Gover- nors, will amend the above law so that as amended the law will read as follows (the italiczed portions Indicate the new matter): 638.23 Compensation. Executors and ad- ministrators shall be allowed such reasonable fee as may be determined by the court, for services rendered, ibt not in excess of the fol- lowing commissions upon the gross assets of the estate listed in the probate inventory for Iowa Inheritance Tax purposes which shall be received as fui compensation fer all ordinary services: For the first one thousand dollars, six per cent; For the overplus between one and five thou- sand dollars, four per cent; For all sums over five thousand dollars, three percent. In substance, the proposed Bill would change the present law so as to include real estate along with personal property in computing fees, thereby removing real estate from the field of extraordinary services.
