PRACTICE NOTE
The Unauthorized Practice Committee
of the Iowa State Bar Association has
recently been notified that the Federal
Trade Commission has advised the Com-
mittee on Unauthorized Practice of Law
of the American Bar Association, that
John C. Kulik and Dorice W. Kulik, ro-
partners trading as Providence Publish-
Ing Company, Keene, New Hampshire,
have accepted and signed agreement that
the acts and practices of advertising and
sale in commerce of printed materials
comprising a package designated Provi-
dence Will Form Package, will be dia-
continued.

STATE TORT CLAIMS ACT
FILED IN BOTH HOUSES
Supreme Court Denies Increase In
Probate Fees By Rule

As stated in last month's issue of THE NEWS
BULLETIN, the Board of Governors at its meet-
ing held In Des Moines on December 1, unani-
mously approved bills providing for a state
tort claims act and a joint legislative study
committee to revise and re-codify the Iowa law
relative to private corporations.
Due to a difference of opinion among mem-
bers of the association relative to the alimony
and child support lien bill, that bill has been
withdrawn from the association's legislative
program by direction of the Board of Gover-
nors and will not be submitted to this session
of the General Assembly.
The headquarters office has been Informed
that the Association's Legislative Committee
and officers held a meeting on January 18 with
all of the lawyer legislators in both houses and
with the Speaker of the House, President of the
Senate and with the majority adid minority
floor leaders in each house.
As of this writing, the bills have been filed
with the appropriate committees in each house
and every effort is being exerted to have the
bill brought out as committee bills.
There Is general agreement among the mem-
bers of the bar that the present method of
handling claims against the state under which
claims are presented to the claims committees
of the legislature Is not satisfactory. The
claims generally do not receive the consider-
ation that they merit for the reason that in the
short one hundred days of the session members
of the General Assembly cannot possibly give
the attention and consideration to the claims
which a judicial determination would provide.
The proposed act provides a fair and orderly
procedure for the handling of such claims, the
legislation Is just and Is modeled upon, although
not identical with, the highly successful Fed-
eral Torts Claims Act.
Last month's Issue of THE NEwS BULLETIN
contained an article relative to the proposed
bill to provide for a legislative study commit-
tee to revise and codify the Iowa Corporation
Law. The members of the bar are in general
agreement that a new and complete corpora-
tion code is badly needed in Iowa, not only
because the present law is antiquated and has
not kept pace with developments in taxation
and other fields, but also the industrial develop-
ment of our state is hindered because of our
cumbersome corporation laws. The Board of
Governors of the association has expressed its
intention to make the facilities of the Iowa
State Bar Association completely available to
such a study committee if the bill is passed.
As reported last month in THE NEWS BULLE-
TIN, the Special Committee on Statutory
Fees and the Advisory Committee on Rules
to the Supreme Court have recommended to

the Supreme Court that probate fees be in-
creased by court rule, the rule to be filed with
the state legislature under the court's rule-
making power. The officers of the association
have been advised that the Advisory Commit-
tee met with the court and that the court
disapproved the proposed rule and refused to
adopt the same for filing with the legislature.
In view of this development, consideration is!
now being given by the officers of the Asso-
ciation and the Board of Governors as to
whether an affirmative approach to increase
probate fees should be made in the form of a
separate bill for that purpose or whether the
association should recommend, in the event
the Corporate Study Committee bill passes
successfully, a Legislative Study Committee to
revise and re-codify the Iowa Probate Code.
Such a revision would undoubtedly include con-
sideration with respect to fees. Further de-
-.velopmens in this respect will be reported In
further issues of THE NEWS BULLETIN.
Every member of the association will be ad-
vised by letter direct from the headquarters
office at the time the associations bills appear
on the calendar in each house and the request
will be made at that time that each n..mb'
and each county bar association again contact
their representatives and senators urging adop-
tion of the legislation. It is anticipated that the
State Tort Claims Act will meet with difficulty
in the House. It will be recalled that this bill
successfully passed the Senate in the last ses-
sion but failed passage in the House. There-
fore, in this session an effort is being made to
first pass the bill in the House and then take
it up with the Senate. All members will be
