Orlin Backes Admitted To
The American College Of Trial Lawyers
Orlin W. Backes, Minot, has become
a Fellow of the American College of
Trial Lawyers. A position of honor,
membership is only by invitation of the
Board of Regents,
The College is a national association
of 4200 Fellows in the United States
and Canada. Its purpose is to improve
the standards of trial practice, the ad-
ministration of justice and the ethics of
the trial branch of the profession.
The induction ceremony took place
during the recent Annual Banquet of
the American College of Trial Lawyers.
More than 1100 persons were in atten-
dance at the meeting of the Fellows
held in New York City.
Backes is a partner in the firm of
McGee, Hankla, Backes & Wheeler,
Ltd., and has been practicing in Minot
for 23 years.

The Confiscatory Price Statutes: R

In the past months, a number of
defendant farmers have raised the
confiscatory price statutes as a possi-
ble defense to foreclosure. Two recent
Supreme Court cases have helped to
clarify questions as to the availability
and validity of the statutes, but have left
others unanswered.

The confiscatory price Statutes,
codified at NDCC Sections 28-29-04
through 28-29-06, were passed during
the Depression to provide some relief
to indebted farmers. The statutes give
North Dakota courts the power to delay
foreclosure proceedings when the cost
of producing farm commodities is
greater than prevailing prices.

McGee Elected To
ABA's Board Of
Governors
Richard H. McGee, partner in the
Minot law firm of McGee, Hankla,
Backes & Wheeler, Ltd., has been
elected to the American Bar Associa-
tion Board of Governors. The election
took place in August at the 1986 ABA
Annual Meeting in New York City.
McGee will serve a three-year term
representing the 10th district, which in-
cludes Kansas, Minnesota, Nebraska,
North Dakota and South Dakota.
The 32-member Board of Governors
meets up to six times each year to direct
association management and ad-
ministration. With more than 320,000
members, the ABA is the largest volun-
tary professional association in the
world.
As ABA Delegate, McGee has been a
member of the policy-making ABA
House of Delegates since 1966. Active
in the American College of Trial
Lawyers, the International Society of
Barristers and the American Bar Foun-
dation, he is a past president of the State
Bar Association and the fourth recipient
of the Bar's Distinguished Service
Award.

almost fifty years. However, current
conditions in the agricultural economy
have prompted new interest in these
old debtor-relief measures.
In Folmer v. State, 346 NW 2d 731
(N.D. 1984), and Heidt v. State, 372
NW 2d 857 (N.D. 1985), the statutes
