The 1971 legislative session Is in full swing and
all of the Bar Association approved legislative
measures have been introduced. Then cover a
wide range of topics, from repeal of the guest
statute, adoption of comparative negligence,
judges' salary increase bill, filing fee bill, and
numerous others in which the Association has
at least a collateral interest.
The results of the Bar Association referendum
on the filing fee bill shows an overwhelming
majority of lawyers favored the repeal of the
filing fee appropriation to the Association. At
the suggestion of one of our past presidents,
Bob Dahl, the Executive Committee, in line     ,
with referendum results, adopted position 4 fa-
oring the repealing of the filing fee statutory
appropriation, but favored supporting an a.
mmndment whereby the Association will rec-
love 100%, rather than 80%, of the Bar As.
sociation dues. As you know, 20% of the 7
Association dues go to the Bar Board, which I
Is Independent of the Association and which Is
a state agency. TheAAsociation's oroo

t at the $2.50 o t   filng fee would continue
to be appropriated, not for the Association,
however,, but for the Bar Board, and the Bar
Board would then support about $9,000 worth
of Public Interest': programs, which would
then be eliminated from the Asoclation budget.
If the Bar Associtlon receies 100% of Its nmem-
bership and lIcense fees and discontinued these
certain programs, the Bar Assoclation's finan-
cial postion would not be altered. This ar-
rangement is being proposed to the legislature.
A bill has been Introduced to raise district Jud-
gs' salaries to $26,000 and Supreme Court
dges' salaries to $32,000. This appears to be
In a realistic range. a.. hopefully, the leis-
lature will act favoraby on these salary in-
creases. The senate has already passed a salary
Increase bill for county judges.

A special committee, headed by Robert Vogel
of Mandan, has been appointed on the subject
of automobile reparations, and within the scope
of the duties of this committee is to shepherd
the comparative negligence bill and the bill
repealing the guest statute through the legis-
lature. The principle of comparative negligence
has been approved both by the American Bar
Association and our State Bar Association at
the Williston meeting.
The Uniform Court Study committee has intro.
duced a bill providing for supervision of all
courts by the Supreme Court. This statute will
Implement S86 of the Constitution which pro.
vides that the Supreme Court shall have super-
vision over all Inferior courts as may be pro.
vided by law.
Pursuant to the authorizatlon of the Executive
Committee, I have appointed a special corn-
mittee, heeded by Dan Chapan, to review the

In light of the Clark report, Initially, I had pro.
posed that the Supreme Court of North Dakota
appoint such a committee, but the Supreme
Court declined feeling that the Bar Association
should make the study and then make recom-
mendations to the Supreme Court for such
changes In the rules as may be advisable in light
of Justice Clark's special subcommittee report
to the Association at the June Meeting of the
Association In Minot.
