Hon. Noah H. Swayne
(18o4-1884)

Noah Hayne Swayne was born in
Culpeper County, Virginia on Decem-
ber 7. 184 and died in New York on
June 8, 184. His burial place is at
Oak Hill Cemetery in Washington,
D. C. Of Quaker descent his early
education was directed in that philos-
ophy. Though be commenced studies
to qualify him for a doctor's career,
be abandoned it for the pursuit of
law. In I8 he was admitted to the
bar. Disagreeing with principles of
slavery be left Virginia and settled in
Zanesville and later Coshocton' Ohio.
His political career saw him county
prosecuting attorney from 1826 to
1829. In the latter year he became
a member of the Ohio legislature.
Between 1831-1841, he held the posi-
tion of United States District Attor-
ney for Ohio. He acquired a substan-
tial law practice and was consistently
anti-slavery. Upon the recommenda-
tion of Justice McLean    President
Lincoln appointed Noah H. Swayne
as Associate Justice of the United
States Supreme Court in 1862. He

remained in that service until 1881
when he retired because of advanced
age- His career as a justice was un-
spectacular, but steady. His opin-
ions were characterized by a definite
nationalistic quality.  Among  the
notable cases in which he participated
were Gelpcke v. City of Dubuque (68
U.S. 175), Springer v. U. S. (102 US
586), Texas v. White (74 US 700),
Hepburn v. Griswold (75 US 603),
and the famous Slaughter House
Case (83 US 36).
Honorary Doctor of Laws degrees
were conferred upon him by Dart-
mouth College, Marietta and Yale
University.
In 1832 Noah H. Swayne married
Sarah Ann Wager of Harpers Ferry,
Virginia. While she was an owner of
slaves, in honor of her marriage she
emancipated them all. Her son, Wa-
ger Swayne, later Civil War General,
carried on the family tradition of
anti-slavery and did much to enhance
the condition of the newly-liberated
negroes.
