The Law Here And Over There
T HE presence in our midst last summer of distinguished jurists
1 and lawyers from abroad as guests of the American B~a
Association at its meeting in August proved enlightening as.
well as stimulating to the Chicago Bar. It served to emphasize
conditions and characteristics common to the work of the lawyer
here and across the seas.
Keen minds were in abundance. At first, differences of speech
and manners made an impression, but as time passed striking re-
semblances forced themselves to the front. It was somewhat
startling at times to hear lawyers, products of French life and
customs, trained in French law, reveal in discussion a terminology,
a method of analysis and a sequence of argument strikingly similar
to those of lawyers indigenous to our own soil. The law brands
her servants.
More than a century and a half ago a famous observer noted that
the profession of the law was filled with multitudes of ingenious
gentlemen who starved one another and, like Virgil's army were
so crowded that many of them had not room to use their weapons.
They are as numerous today, applying either the civil law or the
common law. Among them are to be found both the litigious and
the peaceable. Whether they look back to Justinian or to Black-
stone, men that hire out their words and anger seem very much
the same everywhere.
As for the litigants their condition in all countries is equally
unfortunate. Apparently the misery of a lawsuit is universal.
