Burgess ascends
to federal court

If you had told UAF Nanook center Tim
Burgess to take a seat on the bench in 1977,
he would have been disappointed; today, he
has happily taken a seat on the bench after
being appointed to the U.S. District Court for
the District of Alaska.
Burgess was sworn in on January 22 after
being nominatedbyPresident George W. Bush
on July 28, 2005 and confirmed by the U.S.
Senate on December 21. The seat he has taken
was previously occupied by James Singleton.

investiture ceremony on February 28 at the
Anchorage Museum of History and Art.
Judge Burgess conies to the I.S District
Court from the U.S. Attorney's Office, where
hserved astheU.S. Attonney for Alaska since
2001 and Assistant U.S. Attorney for 12 years
starting in lq89. Burgess started his legal c-
reer in Anchorage at thelaw firm of'Gilmore &
Feldman in 1987, the year he graduated from
Northeastgrn University School of Law. He
holds a BA and an MBA from the University
of Alaska and worked as a legislative aide
for U.S. Senator Frank Murkowsi before at-
tending law school. Judge Burgess is married
t Chief Assitant Attorney General Joanne
Grace. They have four children.
Since 20C4 Burgess has led the Rural
Justice and Law Enforeement Commission
as the federal co-chair. The commission was
created byCongress to investigate barriers to
justice in rural Alaska and will issue a repont

Conduct rules up for revision

Professional rondact rles have come along way
since the Alabama BarAs ocistion adopted a Code
of Ethics in 1887. The American Bar Association
(ABA) issued its Canons of Professional Ethics in
1OS, followed by the Model Code of Professional
Responsibility in 1969, and then the Model Rules
of Professional Conduct in 198d. Not content to
stand still, the ARA formed an Etics 2000 Com-
mission to review the Rules of Prfensirnal Conduct.

After extensive review and debate, the ABA House
adopted revisions in 2002 and 2003.
And, of course, those revisions landed on the
desks of the nine members of the Alaska bar's
Rules of Professional Conduct Committee: Jerry
Juday, Liz Hiekerson, DougJohnson, Judge David
Mannheimer, Judge JohnLohff. John Murtagh, Bob
Bundy, Ruth Hes-e, and Bob Mahoney. Little did
