CHAIR'S CORNER

As I sit down to write this column, having just assumed the position of Chair of the ADR Section at our
annual meeting in Ft. Worth, I find myself somewhat humbled by the standards of leadership which have
been established by my predecessors. And while the task is daunting, I pledge to you that I will attempt to
uphold those high standards.
In the year to come, the issue of regulation of the ADR profession will continue to require a great deal of
attention from our section. Fortunately, we have members who are in the leadership of both of the major
efforts to deal with regulation of the profession. First, John Palmer and Suzanne Duvall are *providing
leadership in the Texas Mediator Credentialing Committee (the TMCC). The TMCC, which is composed of
representatives of a number of organizations and groups involved in mediation, is currently considering
proposals for a voluntary Credentialing program for mediators. Second, Bruce Stratton serves as Co-Chair
of the Supreme Court Advisory Committee on Court-Annexed Mediation. This body has proposed a set of
mandatory ethical rules for mediators, and the Supreme Court has asked the committee to address a
number of issues related to implementation of the proposed rules, if promulgated. Obviously, both of these
efforts have the potential to significantly impact the mediation profession, and it is critical that the ADR
Section remain fully involved in the development and debate of these proposals.
Issues related to confidentiality of communications in ADR processes are arising at an even faster rate
than the increase in the use of ADR in the resolution of disputes in the public sector. No doubt the conflict
between the ADR participants' right to confidentiality and the public's right to know will continue to grow in
the year to come and threatens to significantly affect established standards of confidentiality in the private
sector. in my opinion, our section's involvement in this debate is imperative, not only for the protection of
consumers of ADR services, but for practitioners, as well.
The Texas Legislature has gone home, everyone has given a sigh of relief, and now we have two more
years before the legislature meets again. But, our efforts to monitor and affect legislation must continue as if
the legislature were still in session.
