6068-A which modifi s Rule 2103 of the C>PLR allowing
attorneys in pe ufing actions to erve ite locutory papers via
FAX
The law r qures 1) Attorneys must first gix e their
wn~nt to r~ei' 1ng F AX paperc, ~ C on ent can be res4~md&l
by serving a notice on the other parti~ 3) The effective date is
January 11990
C'PLR 2013 does not apply t jurisdi tional papers, ic
ummons or subpoena
The amendment p ovides that ervice by FAX may be
made provided that a telephone number or other station is
designated by the attorney for that purpose 'The service
complete upon receipt by th sender (f a signal from the
quipment of the attoi ney served ndicating that the trans-
mi ion v a re cived and mailing of a copy of the paper to
that attorney
Consent to service is aceomp ished by 'The designation
