M     ur. Muiiy of New York, from the Committee on Merchant Marine
             and Fisheries, submitted the following

                        REPORT

                        together with
                   ADDITIONAL VIEWS

                   [To accompany H.R. 14104]
       [Including cst estimate of the Congressional Budget Office]
  The Committee on Merchant Marine and Fisheries, to whom was
referred the bill (H.R. 14104) to authorize appropriations to carry
out the Endangered Species Act of 1973 through fiscal year 1981, and
for other purposes, having considered the same, report favorably
thereon with amendments and recommend that the bill as amended do
pass.
  The amendments are as follows:
  Page 2, line 23, insert final after the.
  Page 2, after line 25, insert the following:
  (4) in subsection (c) by inserting at the end thereof the following
new paragraph:
      (4) The Secretary shall-
          (A) conduct, at least once every five years, a review of
        all species included in a list which is published pursuant
        to paragraph (1) and which is in effect at the time of
        such review; and
          (B) determine on the basis of such review whether
        any such species should-
              (i) be removed from such list;
              (ii) be changed in status from an endangered
           species to a threatened species; or
             (iii) be changed in status from a threatened
           species to an endangered species.
