ALDF W*ins Protection for Primates


In Labs and Roadside Zoos


-NABR appeals

W hen ALDF discovered a chim-
          panzee named Barney in a
          government-licensed game
          farm, he was languishing in
 solitary confinement on the cement floor
 of a caged cell. Deprived of companion-
 ship and veterinary care, Barney suf-
 fered from severe psychological and
 physical distress until he escaped from
 his cage and was brutally shot and
killed by a game park employee.
   ALDF went to court and sued the
 U.S. Department of Agriculture (USDA)
 for failing to enforce the Animal Welfare
 Act (AWA), designed to protect animals
 like Barney from abuse. On October 30,
 1996, U.S. District Court Judge Charles
 Richey ruled that the USDA had violated
 the AWA and must rewrite its rules to
 prevent animal suffering and ensure the
 psychological well-being of captive pri-
 mates. Judge Richey called the USDA's
 failure to issue such standards egre-
 gious. This case involves an abject
 failure in the rulemaking process... to
 enforce the AWA, he stated.
   In 1985, Congress amended the
 AWA, the only federal law which pro-
 vides protection for animals used in
 research facilities and zoos, and ordered
 the USDA to develop more humane
 standards for animals in captivity. For
 eleven years, USDA has steadfastly
 refused to set such standards and ALDF
 has sued USDA repeatedly to force the
 egency to do its job. We've proven our-
 elves to be the only organization capa-
 ble of taking on the research industry in
 court and winning!
   This is an historic victory that could


vastly improve conditions
for captive primates every-
where, from private ani-
mal dealers and roadside
zoos to research laborato-
ries. The court vindicat-
ed our claim that the
USDA is unjustly denying
primates the protections
they are supposed to have
under the AWA, said
Valerie Stanley, the ALDF
staff attorney who han-
dled the case.
   After ALDF's victory,
the National Association
for Biomedical Research
(NABR) filed a notice of
appeal and the USDA followed suit.
They clearly understand the true stakes
in this baffle. If allowed to stand, ALDF's
landmark lawsuit will require stricter rules


for the care of all animals in captivity,
including thousands of primates trapped
in research labs. We will keep you

ALDF Opens Animal Care Guide

to Public Scrutiny
or more than four decades, the Guide for the Care and Use of Laboratory Animals
   has been written and revised behind closed doors exclusively by representatives
   of the research industry, who stand to profit most from loose guidelines for the
care of animals in research laboratories. But no longer. On January 10, 1997, the
U.S. Court of Appeals, D.C. Circuit ruled that a National Academy of Sciences (NAS)
committee, which advises the National Institutes of Health on the care of animals
used in research, is subject to the Federal Advisory Committee Act (FACA). As a
result, the NAS is now obligated to open its meetings and records to the public.
  This unanimous decision is a victory for the public's right to know as well as for
animal advocates. ALDF Staff Attorney Valerie Stanley and environmental attor-
ney Eric Glitzenstein worked tirelessly to achieve this victory, which empowers the
public to monitor decisions being made about the standards of care applied to ani-
mals used in research.
