USDA betrays animals

and public trust


IT'S AN OLD STORY: CONGRESS
passes a law to correct a serious social
problem and directs an administrative
agency to enforce that law. But some-
thing insidious occurs-the federal
agency that is supposed to be a watch-
dog over the regulated industry be-
comes, instead, its lap dog-making
excuses and allowing the powerful in-
dustry to get its way. Then some re-
sponsible agency employees decide it's
   e to do what Congress intended:
trite strict regulations to enforce the
law and curb the problem. This should


have been the happy ending. But that
didn't happen at the present day U.S.
Department of Agriculture.
   In 1985, Congress amended the
Animal Welfare Act and directed the
USDA to develop stricter standards for
the welfare of animals used in research.
In particular, USDA was directed to
develop standards regarding exercise
for dogs, and a physical environment
adequate to promote the psychological
well-being of primates.

KAMA, A 700-POUND BOTTLE-
nose dolphin, has sued the Na-
tional Marine Fisheries Service
(NMFS), challenging the routine
use of Letters of Agreement to
transfer captive marine mam-
mals. This type of transfer is be-
ing used instead of the formal
permit procedure which would
require that the public receive
notice of the permit application
and an opportunity to submit
comments. The informal Let-
ters process has encouraged
commercial trade in dolphins,
which is precisely what the 1972
Marine Mammal Protection Act
was passed to correct. (For
