ALDF FORCES USDA TO PROTECT PRIMATES IN LABORATORIES AND
ROADSIDE ZOOS
ALDF has won a battle for primates held by research laboratories, roadside zoos and animal
dealers. On October 30, 1996, U.S. District Court (D.C.) Judge Charles Richey ruled that
the U.S. Department of Agriculture's regulations addressing the psychological well-being of
primates violate the federal Animal Welfare Act and must be rewritten.
In 1985, Congress amended the Animal Welfare Act, the only federal law which provides
protection for animals used in research facilities, zoos and other exhibitions, and ordered the
USDA to develop stricter standards, including physical environments adequate to promote the
psychological well-being of primates. Judge Richey called the USDA's 11 year failure to
issue such standards egregious. The National Association for Biomedical Research
(NABR) has intervened and filed a notice of appeal. (ALDF v. Glickman, PF 741.20)
APPEALS COURT HOLDS THAT NATIONAL ACADEMY OF SCIENCES
MUST OPEN DOORS TO PUBLIC
On January 10, 1997, the U.S. Court of Appeals, D.C. Circuit, ruled that a National
Academy of Sciences (NAS) committee, which advises the National Institutes of Health on
the care and treatment of animals used in research is subject to the Federal Advisory
Committee Act (FACA), to wit, it should have opened its meetings to the public and not
proceeded in secret. This unanimous decision is a victory for the public's right to know and
for animal advocates. For over four decades, the Guide for the Care and Use of Laboratory
Animals (Guide) has been published by a principal arm of the NAS and includes the
guidelines for handling and monitoring the treatment of animals in research. Traditionally,
the Guide has been written and revised only by representatives of the research industry.
Appellants, ALDF, Psychologists for the Ethical Treatment of Animals and the Association
of Veterinarians for Animal Rights, sought access to those meetings and to any minutes,
transcripts, or records of the Committee under FACA. The District Court granted
defendants' motion for summary judgment, concluding that the Guide Committee was not an
