SUIT CHALLENGES PRIMATE RESEARCH AT UC DAVIS
A citizens group filed a petition for writ of mandate in Superior Court to challenge the
legality of the approval of a primate research facility proposed by the University of
California in Davis, California. Represented by attorney Dan Whaley, plaintiffs allege
that the University failed to conduct an adequate environmental analysis under the
California Environmental Quality Act or to allow for public notice and comment on the
project. The petition alleges inadequate disclosure of environmental and public safety
hazards, including biohazardous waste, risk of contagious disease from nonhuman
primates, possible harm from toxic dumping to a nearby community, UCD's record of
inhumane treatment of primates, as well as the cumulative impacts of related projects.
The Court ruled against plaintiffs on their motion for a temporary injunction and
defendants are seeking summary judgment on a statute of limitations claim. (WDCA v.
Regents of the Univ. of California, PF 670.30)
MEDICAL STUDENT SUES UNIVERSITY OVER DOG LABS
A first year medical student sued the University of Colorado School of Medicine for
failing to provide reasonable alternatives to vivisection of animals in a required
physiology course. The student, represented by attorney Elisa Moran, alleges that such
action denies her right to free exercise of religion, free speech, freedom of association,
due process and equal protection, and seeks declaratory and injunctive relief and
damages. Defendants unsuccessfully moved for summary judgment and trial is set for
May 15, 1995. (Rubaii v. Univ. of Colorado Health Sciences Center, PF 530.50)

GROOMER SUED FOR DOG'S DEATH IN CAGE DRYER
A Nevada couple sued a pet store chain/groomer and the manufacturer of a cage dryer
when their two dogs were seriously injured during the grooming process. One dog died
of heat stroke. The suit alleges negligence, fraud, misrepresentation, strict liability,
