ALDF FORCES USDA TO PROTECT ANIMALS IN LABS
U.S. District Court Judge Charles Richey has ruled that the U.S. Department of
Agriculture's regulations addressing the care of animals used in research and testing are
arbitrary and capricious and violate the Administrative Procedures Act.  ALDF,
represented by staff attorney, Valerie Stanley, sued to compel the USDA to enforce key
provisions of the Animal Welfare Act regarding exercise for dogs, and a physical
environment to promote the psychological well-being of primates. The  USDA  is
expected to appeal. (ALDF v. Secretary of Agriculture, PF 204)
EXOTIC ANIMAL ORDINANCES CHALLENGED
In separate cases, the owners of two pet stores that specialize in exotic animals have filed
suit against the towns of Austin and Jefferson, Indiana to contest ordinances that regulate
the ownership and sale of animals such as lions, wolves, wolf hybrids, raccoons, and
primates. Both proprietors allege that townships do not have the power to enact a ban
on the trade in exotic animals, since it is regulated by the federal Animal Welfare Act and
does not fall under a city's jurisdiction.
Attorney Larry Silver has submitted amicus briefs in each case on behalf of ALDF,
arguing that the local regulations are not preempted by the Act. (Dehart v. Town of
Austin, Indiana, PF 740.60) and (Pet Paradise v. City of Jefferson, PF 740.30).
SUIT CHARGES AMERICAN AIRLINES WITH CAT'S DEATH
A suit was filed by attorney Joseph Kibre against American Airlines on behalf of the
owners of a cat who was killed by an American Airlines baggage truck when American
allowed him to get loose in the baggage area of the airport. The suit charges the airline
with breach of contract, negligence per se and gross negligence. Plaintiffs are seeking
general, punitive and mental distress damages. (Browde v. American Airlines, PF
281.50)
