CLASS ACTION FILED TO ENFORCE KENTUCKY DOG LAWS
The Trixie Foundation and numerous animal organizations and individuals, representing similarly
situated Kentucky citizens, filed a class action suit July 10, 2000, in Franklin Circuit Court.
Named defendants include Agriculture Commissioner Billy Ray Smith, county judge executives,
county commissioners, county magistrates and other members of various county governing bodies.
The action was filed pursuant to Kentucky statutes, KRS Chapter 258, first enacted in 1954, which
obligate counties and the Commissioner of Agriculture to implement certain practices and
procedures to protect and regulate the dogs of the Commonwealth. KRS 258.195 requires the
Fiscal Court of each county to employ a dog warden and establish and maintain a dog pound.
KRS 258.215 requires that impounded dogs after a statutorily defined period be euthanized in a
humane manner.
Plaintiffs allege damages resulting from defendant county officials' failures to employ dog
wardens, establish acceptable or in some cases any pounds, and humanely euthanize dogs.
