The revision proposed by the Council on Environmental Quality on October
7, 2021 to the regulations implementing the National Environmental Policy Act
would yield harmful outcomes in terms of environmental quality, safety, and the
economic costs of capital investments and environmental protection. Accordingly,
it is a perverse proposal, and should not be finalized.
This comment paper to the Council on Environmental Quality addresses the adverse
environmental, safety, and cost effects of the rule proposed on October 7, 2021 to revise the
implementing regulations for the National Environmental Policy Act.1 This proposed rule should
not be finalized in its current form; instead the final rule published on July 16, 2020, which took
effect on September 14, 2020, should be preserved.2 This comment paper is organized as follows:
