Despite the growing support for economic models of deterrence and criminal motivation, the use of welfare economics in formulating crime poicy is not free of problems. Professor Sedgwick finds that, although such models prob- ably should replace older causal theories of criminal motivation, their use may lead the poiicy maker to depend too much on public pref- erences in formulating law-enforcement goals. To the extent that wefare economics relies wholly on consumer sovereignty to identify desirable policies, the author argues, that paradigm may be incompati- bie with Anerican political traditions and respect for human rights. jeffrey Leigh Sedgwick is assistant professor of political science at the Univer:ity of Massachusetts.
