It describes a representative selection of criminal cases involving Aboriginal defendants, in which issues of traditional punishment and/or Aboriginal community opinion were discussed. It is circulated on a limited basis to persons and organisations who may wish to provide initial comment before the issues raised are further considered in detail by the Commission. The Commission is also preparing Research Papers No. 6 and 7 which discuss the issues of substantive criminal law and sentencing in some detail. It is proposed to re-issue this Paper at a later stage as further cases become available.
