§ 425. Antisuit Injunctions
W.Va.2021. Quot. in sup. After insured opioid distributor and affiliated entities sued insurers, seeking a
declaration that plaintiffs were entitled to payments from defendants arising from underlying opioid-
related lawsuits, plaintiffs filed a motion for anti-suit injunction, alleging that defendants should be
barred from pursuing collateral insurance litigation in foreign states, because defendants sought to
resolve issues in foreign jurisdictions that were pending before the trial court. The trial court granted
plaintiffs' motion for anti-suit injunction. This court affirmed in part, holding that defendants were
barred from litigating questions of insurance-policy interpretation in foreign jurisdictions that were also
pending in this jurisdiction. Citing Restatement Fourth of Foreign Relations Law § 425, the court
explained that this instant action and the cases pending in foreign jurisdictions had similar parties and
issues, and resolution of this action would dispose of a significant portion of the foreign-jurisdiction

United States residents with relatives and friends in Haiti filed a class action against the government of
Haiti, three of its former presidents, and companies that facilitated remittances and phone calls between
the United States and Haiti, alleging that defendants conspired to fix the prices of remittances and calls
made between plaintiffs and their Haitian contacts in violation of federal antitrust laws. The district
court granted defendants' motions to dismiss. This court reversed in part, holding that the act of state
