§ 83. General Rule

C.A.D.C.2022. Subsec. (1) quot. in ftn. Former officers of businesses that contracted to provide customs
products to Barbados sued international bank that financed the contracts, alleging that bank violated its
internal investigatory procedures when investigating allegations that officers had engaged in prohibited
practices, which ultimately led to the imposition of severe sanctions against officers. The district court
granted bank's motion to dismiss based on its immunity under the Foreign Sovereign Immunities Act
and the International Organizations Immunities Act. This court affirmed. The court rejected officers'
argument that bank waived its immunity, citing Restatement Second of Foreign Relations Law § 83 in
explaining that an international organization had such immunity from the jurisdiction of a member state
to prescribe or enforce rules of law as was necessary for the fulfillment of its purpose as it was stated in
its constitution. Rosenkrantz v. Inter-American Development Bank, 35 F.4th 854, 869.
