Questions Suggested for Discussion at
Eleventh Annual Meeting
May 4-6, 1933         //; )
Discussion is not confined to the questions pre-
sented here. In view of the limited time for discussion,
however, those attending the meeting should come pre-
pared to ask specific questions or to raise specific points.
Section 1040.
Should the prvilege to enter land in the possession
of another for the purpose of averting a public disaster
be restricted to situations where such entry is neces-
sary, or should it also be available if the entry reason-
ably appears to the actor to be necessary in order to
avert the disaster?
Section 1041.
Similarly with respect to private necessity: Should
the privilege be available only where the entry is neces-
sary to accomplish the protection sought, or is it suffi-
cient that the actor reasonably believes it to be neces-
sary?
Section 1041, Subsection (2).
Should the doctrine of incomplete privilege here
stated be approved? The same question is also perti-
nent with respect to Subsection (2) of Sections 1042
and 1043.
