Questions Suggested for Discussion at
Ninth Annual Meeting
May 7-9, 1931
Discussion is not confined to the questions pre-
sented here. You are earnestly requested to raise any
further points which occur to you.
Section 290. Should a landlord who makes repairs
for his tenant as a pure gratuity be liable, as stated
in Section 290 for the negligence of an independent con-
tractor employed by him to make the repairs, which
results in giving the leased premises a deceptive ap-
pearance of safety?
Section 292. Shoftld the caveat be retained or
should the Section be redrawn so as to make a pos-
sessor of land liable for the negligence of a contractor
employed to construct as well as to repair a building
thereon?
Section 297. Should this Section be redrawn so as
to make the employer of a contractor liable for the
negligent manner in which the work is done not only
under the special conditions stated in this Section and
indicated in the Comment thereto but also wherever
the work is such that it cannot be safely done unless
,special competence and care is exercised and the result
of negligence in these particulars is likely to cause
serious harm? Compare Covington etc. Bridge Co. v.

Engel v. Eureka Club, 137 N. Y. 400, 32 N. E. 1052
