Questions Suggested for Discussion at
Sixteenth Annual Meeting
May 12-14, 1938
Discussion is not confined to the questions pre-
sented here. You are earnestly requested to raise any
further points which occur to you.
1. Introductory Note to Chapter 19. Is the utiliza-
tion of the phrase 'purporting to create remainders
or executory interests described in the first paragraph
of the Introductory Note, clear and acceptable?
2. § 250, Comments d, e and f. Is it useful to make
the detailed analysis of the possible types of situations
within the rule of this Section as is done in these three
Comments?
3. § 251. Is it sufficiently clear that this Section
(§ 251) is subordinate to § 250 merely giving the time
in which the survival (required by § 250) must occur?
4. § 252, Clause (b). Is the conclusion embodied
in Clause (b) approved? Compare Illustration 4.
5. § 252. Is the omission from the blackletter of
this Section of any statement concerning the nature of
the interest of the ' children or ''issue' or '' descend-
ants approved? See Comment f.
6. § 253, Illustration 1. Is it agreed that C's inter-
est is better construed as defeasibly vested than as
subject to a condition precedent?
