PROPERTY TENTATIVE DRAFT No. 6
Questions Suggested for Discussion at
the Thirteenth Annual Meeting
May 9-11, 1935
Discussion is not confined to the questions pre-
sented here. You are earnestly requested to raise any
further points which occur to you.
1. Section 253.
Is it agreed that Section 253 correctly formulates
the prerequisites for any relief against a third person?
See particularly Comments c and e.
2. Section 253, Comment f
and Section 254, Comment b.
Is it agreed that the owner of a future interest can
have protection against conduct of a third person
although completely lacking protection against identi-
cal conduct by the owner of the possessory interest?
3. Section 256.
Is the restriction upon the scope of the principle
stated in Section 256 both readily understandable and
accepted as sound?
See particularly Comments b and d.
4. Sections 254-259.
Can any member of the Institute suggest some pro-
cedure for the protection of future interests not dealt
with in Sections 254-259 which deserves treatment in
this Chapter?
