Questions Suggested for Discussion at
Eleventh Annual Meeting
May 4-6, 1933
Discussion is not confined to the questions pre-
sented here. In view of the limited time for discussion,
however, those attending the meeting should come pre-
pared to ask specific questions or to raise specific points.
AS TO PART III (Future Interests) AS A WHOLE.
Subject Matter:
1. To what extent should the Restatement of Fu-
ture Interests deal with the six types of interests enu-
merated in the inset paragraphs on pages 7 and 8?
2. To what extent is it desirable to postpone to
Part IV the treatment of the Rule against Perpetuities?
(See p. 9, lines 12-25.)
3. Are there any types of interests which should
be treated in Part III other than those expressly men-
tioned in the Scope Note? (See p. 7, line 15; p. 9,
line 37.)
Sequence:
4. Is it agreed that the chapters treating separate
characteristics, such as transferability by conveyance
inter vivos, succession, creditor's rights and the like
should precede the chapters stating the details of the
creating transaction which enable one to determine the
particular variety of future interest created by a par-
ticular transaction T (See p. 10, lines 1-26.)
Terminology:
5. Is it agreed that in Part III we should not con-
form to the usage established in Tentative Draft 1,
whereby possibility of reverter (§ 25), executory inter-
