Memorandum to Advisers - Property Group No. (s).
As was agreed at the Philadelphia conference. copy is being sent
of the revision of Preliminary Draft No. 8, regarding lateral and subjacent
support. Please look over this draft and let me have your comments, if any,
with-In two days after receipt of it. It will take only a few minutes to
check the important changes. I list below the changes which are worth
scrutiny.
Blackletter, Sec. 1. Note the division into two subsections.
Caveat to the section immediately following it.
Sec. 1, Comment J, second paragraph, about ten lines down, beginning In
such case, and about aix lines farther down, the sentence beginning But
if the actor. (Tis comment was Comment e in Draft 8.)
Sea. 5, Comment a. Note the new order as agreed upon.
Sea. 5> Comment f, about 15 lines down. Note the sentence, Normally the
possessor of the supporting land. It was substantially agreed upon.
Note the last sentence of the first paragraph of Comment f, Sec. 5. This
is new and 5portant. There are several dicta to support it.
Note the last paragraph of Comment f. (This was Comment f in Draft 8).
Sec. 3,Commont h, second paragraph. Note the change from Comment h, Sec. 5
of Draft 8.
Sec. 4 , blackletter. Note the division into two subsections.
Sec. 4, Coment d has been substmatially changed from See. 4, Comment d of
Draft 8.
See. 5. Note the new Comment d.
