Questions Suggested for Discussion at
Twelfth Annual Meeting
May 10-12, 1934
Discussion is not confined to the questiors pre-
sented here. You are earnestly requested to raise any
further points which occur to you.
1. §332. If the trustee of a spendthrift trust
tranfers the trust property to the beneficiary, should
the beneficiary be permitted to hold the trustee liable,
as stated in Subsection (2) and in Comment f?
2. § 351. Should the rule stated in Subsection (1)
be applicable where the testator's intention to create a
charitable trust appears in the will, but the nature of
the intended charitable trust appears only from an oral
agreement made by the devisee or legatee with the
testator, as stated in Comment e?
3. § 381. Should the words by the settlor in
the fifth line of the Section be omitted, and should it be
stated in Comment e that the settlor can maintain a
suit to enforce a charitable trust?
