AGENCY TENTATIVE DRAFT No. 5
Questions Suggested for Discussion at
Eighth Annual Meeting
May 8-10, 1930
Discussion is not confined to the questions pre-
sented here. You are earnestly requested to raise any
further points which occur to you.
1. Is the conception of servant as described in See-
tion 445 correct? Is it adequately expressed?
2. Should the apparent owner of a business be
liable to one injured by an employee of the business
in the scope of employment where the injury is not
caused by reliance upon such apparent ownership?
(Section 446, Comment c.)
3. What should be stated as the liability of a mas-
ter to one who has been invited upon the premises or
vehicle of the master by a servant without authority
to do so? (Section 467.)
4. Where the instrument embodying a contract
made by an agent on behalf of a principal states that
the agent is not authorized to make representations
other than those written upon it, should the other party
to it who has been induced by fraudulent oral state-
ments of the agent be permitted to rescind the trans-
action? (Section 484.)
5. Are the statements in regard to notice and noti-
fication in Sections 491 and 492 accurate and adequate?
