Bus passenger sued public transit authority, alleging that defendant's bus driver acted negligently by abruptly deploying the brakes to allow a passenger off the vehicle while plaintiff was standing onboard, resulting in plaintiff falling and injuring himself. The trial court entered judgment on a jury verdict for plaintiff. The court of appeals affirmed. This court affirmed, holding that the evidence supported a jury finding that defendant acted negligently when its driver failed to meet the heightened standard of care applied to common carriers. Citing Restatement of Conflict of Laws § 167, Comment a, the court explained that defendant was a common carrier that was in the business of transporting people, because, as a public transit authority, it held itself out as a common carrier, undertook requests to transport people, and was created to operate a transport business.
