Generally

D.N.M.2019.  Cit. generally in case cit. in disc. and in ftn. New Mexico patient brought a lawsuit against
out-of-state designers and manufacturers of surgical mesh, alleging various claims arising from a
defective surgical mesh that was implanted in plaintiff. This court granted defendants' motion to
dismiss, holding, inter alia, that the New Mexico statute of limitations barred plaintiff s negligence,
breach-of-warranty, and strict-liability claims. The court noted that New Mexico followed the
Restatement of Conflict of Laws for analyzing choice-of-law issues, which was nearly identical to the
Restatement Second of Conflict of Laws in regards to the determination of the applicable statute of
limitations. Nowell v. Medtronic Inc., 372 F.Supp.3d 1166, 1217, 1218.

§ 9. Domicil

Mass.App.2019.  Com.  (e) quot. in ftn. Pedestrian who was stopped by a state trooper on an interstate
highway  in Massachusetts, approximately six miles south of the New Hampshire border, was charged
with and convicted of possession of a firearm without a license in violation of Massachusetts law, even
though he possessed an active New Hampshire license to carry a firearm. Affirming in part, this court
held that the trial court properly denied defendant's request to instruct the jury on the new-resident
exemption, which provided that new residents moving to Massachusetts were exempt from firearm-
licensing laws for 60 days. The court cited Restatement of Conflict of Laws § 9 in reasoning that
defendant, who claimed to be homeless and carried items indicative of someone camping, could not be
considered a resident, because the evidence showed that he was in Massachusetts temporarily to meet a
friend before moving on to Michigan and other states. Commonwealth v. Paul, 132 N.E.3d 544, 551.
