Valuing Damages in Employment Cases
Rhonda Anderson Marks 11
The typical plaintiff in an employment discrimina-
tion case is absolutely, unshakably certain of some-
thing: that his or her case is worth a fortune in dam-
ages. This, of course, is rarely the case. But how do
you convince the overly sanguine client? The first
step is to make sure that you really know what the
case is worth and the second is to make sure that the
client understands how you arrived at your num-
bers. In this article, employment litigator Rhonda
Anderson Marks explains how to calculate damages
in employment discrimination cases, and how to
keep the client's expectations down to earth.

Preserving the Attorney-Client Privilege
Herv6 Gouraige and Elisabeth Riedmueller 23
At some point, your business client will probably
have to conduct an internal investigation. The inves-
tigation may arise from a wrongful termination, a
customer complaint, an audit, or a lawsuit. Or there
may be a need for an internal investigation, and your

stances, the client needs to know how to conduct the
investigation when the need arises, and you need to
know how to help the client to preserve the attorney-
client and work product privileges. In this article,
Herv6 Gouraige and Elisabeth Riedmueller explain
how to do both.

gy, the answer is clearly no. But there is more to
conducting the telephonic meeting than setting up a
basic conference call. In this article, J. Grant McGuire
discusses when a telephonic meeting is appropriate,
how to conduct it, and supplies a model bylaw that
specifically allows for telephonic board meetings.

Ilene Knable Gotts 39
Business to business (B2B) electronic marketplaces
create a cost-effective and efficient infrastructure for
industry-specific buyers and sellers to transact busi-
ness. But where there are information exchanges
