THE ADVANTAGES TO BE DERIVED FROM A
COMPARATIVE STUDY OF THE BUSTAMANTE
CODE ON PRIVATE INTERNATIONAL LAW AND
THE AMERICAN LAW INSTITUTE'S RESTATE-
MENT OF THE' LAW' OF CONFLICT

I was glad to accept the suggestion that I should address this S ction of the
Congress on this matter because I am much interested, and I know this interest
is shared by many members of the American Law Institute, in two things:
(1) The increase of the knowledge in this country of what we common-law
lawyers, speak of as the civil law of Latin American countries; and (2) the in-
crease ofthe knowledge in other countries of the Western Hemisphere of the law
of the United States.
*As- regards the best plan by which this increase in our. mutual knowledge
of each other's law may at present best be promoted, I express no opinion except
to say that I hope the work of this Section of the Congress will include a recom-
mendation that the governments of our respective countries appoint representa-
tives to a committee charged with reporting a definite plan designed to promote
a greater understanding among the people of the Western Hemisphere of each
other's laws and legal institutions.
The field of law in which, I submit, a mutual knowledge in one country
of the laws of another has a special value is the field which we in the United
States generally call Conflict of Laws, although it is universally spoken of in
other countries and often in this country as private international law. I need
not'emphasize the importance of mutual knowledge in this field. It is that field
of private law which directly affects business and personal relations between
pers6ns in different states. The Bustamante Code and the American Law Insti-
tute's Restatement of the Law of Conflict of Laws express in varying degrees
respectively the law on this subject of the Latin American countries and the
United States. I say express in varying degrees because the Bustamante Code
and the Institute's Restatement vary from each other not only in the legal rules
stated, but in purpose, scope, and form. I shall leave to others here far better
qualified than I am the explanation of the origin and character of the Busta-
