The Comparative Study of Conflict of Laws

The wide gap in comparative law studies with respect
to conflict of laws and the desirability of makin- conveniently
available to the legal profession the solutions to particular
conflicts problems reached in various countries, inspired the
initiation, in 1959, of a comprehensive study of this important
comparative law field under the auspices of the American Law
Institute. At the time, the director of the Institute, LLr. william
Draper Lewis, referring to this undertaking as monumental,
stated:
ItPublished as it would be in English, it would
stimulate as nothing else a knowledge and interest
in comparative law in this country besides being of
great practical value to those merabers of our profession
who have clients with interests abroad. (16 American

The distinguished European scholar employed for this study,
Dr. Ernst Rabel, founder and until recently director of the
Institut der Kaiser 17ilhelm Gesellschaft f'Ur auslandisches
und internationales Privatrecht in 3erlin and judge ad hoc
at the World Court, by virtue of his wide experience in eling
with conflicts cases and his exceptional background in compara-
tive legal research, is uniquely equipped to deal effectively
with this subject of large international interest.
At the suggestion of the director of the American
Law institute, the University of M:ichigan Law School, moved
by its interest in comparative legal studies, assumed respon-
sibility for Dr. Rabel's work in March, 1942, subject to the
conditions (1) that the Law School should be assigned all
claims to the work which had been done, thus allowing Dr. Rabel
to develop his research without necessarily following the plan
of the Restatement, and (2) that the University's responsibility,
in conformity to the retirement policy applicable to members
of the staff, should not extend beyond the age of seventy.
Accordingly, Dr. Rabel't stipend from the University will
terminate as of January 31, 1944.
The comparative study of conflict of laws under-
taken by Dr. Rabel looks to the publication of a basic treatise
in two volumes comprising a t6tal of 1000 to 1200 pages. The
first volume, including a general introduction and covering
-the important topics of status, marriage, divorce, fm.ily relations
