Letter of Transmittal
To the Members of the Special Committee of the Advisers:
I enclose (1) a preliminery drrft of whrt I h~ave entitled a Declara-
tion of Fundamental Individual Rights end (2) a suggested preliminary draft of
a report to the Council of the Institute.
in doing this I heave tried to fulfill the promise I mede to the October
meeting of your Committee. You vdll note that I have not given in the Comment
eny -rgument for the inclusion of the Article 's an essentiel right. I did this
because I felt that the mjority of your members desired that the Comment should
be short end non-argumentative. In the suggested preliminary draft of a report
which Might go from the Advisers to the Council of the Institute I have introduced
argumentative metter taken from longer zrgumentative metter submitted by several
of your members.
is to the comments submitted, you ill find that the comments which I
have rewritten end condensed relate to the articles subsequent to Article 9. 1
regret that it was not possible for me in view of the limitations of time to do
the necessary polishing of the languge in these comments. I em in hopes,
however, that what I have done i,'ll enable you to pass finally on U questions
of the form of the comments end also take steps to improve the text.
The work has necessitated my close study of the !inutes of your October
meeting' I am irpressed with the fact that all of us should recognize .the dis-
couragement whicn wll result if a reargument of all tbe metters argued at your
two prior meetir.gs would take place. Such a procedure would, I fear, tend to
end any reasonable prospect of completing this Institute Projejct witbin the funds
now available or at a time sufficiently before the cessation of hostilities with
Germany to secure for the conclusions reached such adequate public discussion
