Dear Chief JusticeBa~ke:
I have received your letter of December 6 and note that you expect to
attend the National Peace Conference of the Federal Council of Churches at Cleveland,
January l6-l9~,
The positio. of The Amrican Law In.;titute in regard to its work on this
subject should,- I thinks. be clearly understood. The Institute never undertook to
draft an International Bill of Rights. That they have done in order to lay a found-
ation for intelligent work on an International Bill of Rights was to appoint, now
nearly three years ago, a committee composed of representatives of the principal
-cultures of the world to see how far the could unite on what were essential human
rights. Last February the committee made a final report and a-formal statement of
the agreements they had reached in regard to essential human rights.
The Council of the Institute realize that as this document contains several
rights not in our own Federal and State Constitutional Bills of Bignts, especially
those relating to social rights, that any attempt on the part of the liu-titute to
itself draft an International Bill of Rights would produce arguments at the Annual
Bleeting which would inevitably tend to degenerate into a political argument. They,
therefore, decided to print the report of the committee with a statement that with the
report this concluded the work of the Institute as in their opinion it was not prac-
ticable for the Institute to attempt to draft an International Bill of Rights.
Te Annual Ueeting of the Institute last May acquiesced in this action.
