restitution, although the exact content of the latter
term must await the completion of a succeeding
Pamphlet. Are we correct in drawing this distinction?

gested eliminate as far as possible the elements of un-
certainty in its application and in the process of valu-

Is it possible to state a rule for determining when
evidence creates a reasonable degree of certainty that
profits would have been made and when it leaves the
matter conjectural and speculative?
