Risk Management
Thomas A. Russo
It used to be that when people talked about risk management, they were
referring simply to credit risk and market risk. Now, when people talk about
risk, they also talk about legal risk, compliance risk, financial risk, technology
risk, operational risk, reputational risk, etc. Today, risk management goes
beyond market and credit risk to cover the totality of the environment of the
business (i.e., transactions /deals, operations, infrastructure). In short, we can
find risk-however you name it and slice and dice it-in everything we do.

Collection Claims For Contributions To Collectively
Bargained Welfare And Pension Plans
Gerard Morales 15
The Labor-Management Relations Act and ERISA provide federal jurisdiction
over claims seeking enforcement of a collective bargaining agreement's
provisions requiring maintaining or funding employee benefit plans. But there
are many specific rules that must be followed for such a claim to succeed.
Updatedfrom the ALI-ABA Course of Study ERISA Litigation, May 11-13, 2006.
The Sarbanes-Oxley Act: Employment Implications
For Privately Held And Publicly Traded Companies
(With Checklists)
Allen B. Roberts 35
This paper presents a working understanding of the employment law
provisions of Sarbanes-Oxley contained in Title VIII, the Corporate and
Criminal Fraud Accountability Act of 2002, and sounds an alert that
Sarbanes-Oxley is far more complex, far-reaching, and enigmatic than its ease
of passage and much of the early popular comment suggest.
Updated from the ALl-ABA Course of Stud Airline and Railroad Labor and
Employment Law: A Comprehensive Analysis, April 6-8, 2006.
