Questions Suggested for Discussion at
the Fifteenth Annual Meeting
May 6-8, 1937
Discussion is not confined to the questions pre-
sented here. You are earnestly requested to raise any
further points which occur to you.
1. § 7. Section 7, as it is worded, subjects all fu-
ture interests to the claims of creditors, regardless of
the sacrifice that may be caused by a forced sale.
Would it be desirable to include a provision which
would enable a court to set aside or postpone a sale
of a future interest in order to prevent a sacrifice, if
proper provision is made to protect the priority of the
creditor? See Note to the Members of the Institute,
pages 11 and 12.
2. § 8. Which wording of § 8 do the members of
the Institute preferI See Note to the M1embers of the
Institute, page 12.
3. § 9. Does everyone agree that the use of lan-
guage appropriate to create a fee tail estate should
be given such effect as described in § 9?
4. § 12. Is the rule of construction formulated in
§ 12, concerning a gift to one and his children, ap-
proved?
