A sI began to write this let-
ter my office window was
filled with blue skies and
hundreds of hot-air balloons, there
was upheaval in the capital mar-
kets of the world, all Americans
were facing difficult economic real-
ities, and we were in the midst of a
very hard-fought political season.
When I returned to my drafting,
the balloons were gone for another
year and we finished an important
meeting of your Council, but all
else remained in flux.

My point in mentioning the tur-
moil is that periods like this demand
that the law, in its clarity and its abil-
ity to solve current problems, both
be, and be perceived as, fair. Making
this ideal a reality is our work. Dur-
ing the October Council meeting we
discussed drafts for Employment
Law, the Model Penal Code: Sen-
tencing, Torts, and the Principles
of Nonprofit Organizations (those
actually meant to be nonprofit).
These drafts will provide a lively
and important set of issues for all

of us to discuss, debate, and decide
in May at the Annual Meeting. A
key portion of our deliberations at
the Council Meeting also related to
those issues that are about to make
an appearance on our agenda of
projects and some preliminary dis-
cussion of our process for reaching
the point where some substantive
issue becomes the official policy of
The American Law Institute. At this
point we have important projects

CouncoH Apprves Thee Drafts for                                       Meeting
It was a busy time at the Sofitel
hotel in New York City last month,
as the ALI Council at its meeting on
October 16 and 17 approved drafts
for projects on torts, employment
law, and nonprofit organizations
to be considered by the member-
ship at the 2009 Annual Meeting.
A fourth draft on sentencing will
receive further Council review  at
its December meeting in Philadel-
phia and is expected to be on the
Annual Meeting agenda. The Coun-
cil also honored President Emeritus
Roswell B. Perkins with its third
Distinguished Service Award (see
separate article on p. 3) and elected
79 new members (see list on p. 7).
