Compensation and Liability for Product and Process Iniuries
A Project of The American Law Institute
The principal objectives of this project were to conduct a
comprehensive analysis of litigation arising from disabling
personal injuries produced by modern enterprise and modern
technology, and to evaluate the manner in which the system of
tort law was responding to such injuries. The focal point of the
project was accidents and diseases inflicted on patients in the
health care system, on the users of consumer products, on
employees at work, and on people exposed to toxic substances in
the outside environment. The aim was to consider how effectively
tort litigation and liability insurance had performed in
preventing and corpensating such injuries, and the significance
of administrative costs to the immediate parties and the broader
community. Excluded from the project's compass were motor
vehicle accidents and government torts, each of which presented
distinctive and peculiar issues.
Unlike other studies of the tort crisis of the mid-80s,
this project considered in detail four major injury settings that
presented the policy issues in usefully contrasting ways. It
also explicitly situated tort law in the context of the other
social institutions performing many of these same functions
regarding disabling injuries: i.e., market incentives, regulatory
