Discussion of Tentative Draft No. 2 and
Council Draft No. 5
MR. MORGAN - It was definitely decided by the Advisers at any rate that it
would be unwise to attempt to make these rules applicable to administrative
tribunals.    They were of the opinion that before they could attempt to
support a proposal for the applicability of rules to administrative tribunals,
either unlimited or limited, it would require much more time and expense than
we could possibly afford and that if it is to be done by the Institute it
ought to be done as the result of a separate study. Consequently, the' material
in brackets in Rule 1 Paragraph I and Rule 1 Paragraph 6 on page 13 of Tentative
Draft No. 2 was ordered deleted by the Advisers.
Moved and seconded that the advice of the Advisers be accepted
and that the matter in brackets on page 13 of Tentative draft No. 2 be
omitted in Paragraphs 1 and 6 of Rule 1.
Motion carried.
MR. MORGAN  - The other amendment in Paragraph 1 is very simple. It just struck
out the last four words on the ground that they were entirely unnecessary. I think
4:that needs no action. It was thought advisable, however, to insert a definition
of perceive a mattev because it had been used throughout the Rules and the
definition is at the bottom of page 13 inserted in ink.
