Draft Code of Rule, of EvidenceT
Rules 14 - 20
Rile 14. For the purpose of impairing or supporting the oredibility
of a witness the trial judge may in his disoretion permit
any party examining the witness to putp ands subject to the
provisions of Rules _____ (rules concerning privileges)
may require the witness to answer any question concerning his
conduct# occupations place of abodes environments associations
or other matter of personal history which may assist the jury
in evaluating his testimony.
Conments This rule makes important ohanges in the existing law.
First# it completely abolishes the prohibition against im-
peaohing one's own witness during his examnation. Herein
it goes farther than any existing legislation. Second# it
permits the proponent of a witness when examining him to
put before court and jury facts which will assist them in
evaluating his testimony, whether those facts be impairing or
supporting. Third, it puts the application of the rule in
the discretion of the trial judge, and thus erects a safe-
guard against its abuse.
