§ 1.04 Employees of Two or More Employers
Or.App.2020. Subsec. (b) quot. in sup. Former county library worker sued city, alleging that defendant
engaged in illegal employment discrimination when the director of county library-services department
terminated him for whistleblowing activities. The trial court granted defendant's motion for summary
judgment. This court reversed and remanded, holding that the trial court erred in finding that plaintiff
was not defendant's employee, because the undisputed facts indicated that defendant and county library-
services department entered into an intergovernmental agreement under which defendant hired plaintiff,
plaintiff agreed to abide by defendant's policy manual, and defendant explicitly reserved a right to
control plaintiff's conduct. Citing Restatement of Employment Law § 1.04(b), the court explained that
the fact that county department employed plaintiff did not preclude a finding that defendant was also
plaintiff's employer. McClusky v. City of North Bend, 481 P.3d 431, 435.
