§ 2.02 Principles for the Aggregate Treatment of Common Issues
N.D.Ill.2020. Subsec. (a)(1) quot. in sup.; subsec. (e) cit. in case quot. in sup. Customers who purchased
beauty products from retail cosmetics stores in fifteen different states filed a proposed class action
against owner of the stores, alleging that the stores had a practice of reshelving and reselling products
that had been used and returned by dissatisfied customers. This court denied customers' motion for class
certification, holding that customers did not meet their burden to show questions common to all class
members that were centrally important to the resolution of the action, given customers' widely disparate
injuries based on the different products they received. The court cited Principles of the Law of
Aggregate Litigation § 2.02 in reasoning that, to the extent customers identified common issues, they
were not central enough to their claims in relation to the overwhelming individual issues to justify
certifying this case as a class action, even just with respect to those common issues. Smith-Brown v.
