§ 2.02 Principles for the Aggregate Treatment of Common  Issues

E.D.Pa.2019. Subsec. (e)(2) quot. in case quot. in sup. In multidistrict litigation, end payors of a drug
used to combat opioid addiction brought anti-trust claims against manufacturer of the drug, alleging that
defendant stopped selling the drug in tablet form and began selling it as a sublingual film in order to
foreclose generic competition and preserve monopoly profits. This court granted in part plaintiffs'
motion for limited certification of an issues class of end payors under Rule 23(c)(4) of the Federal
Rules of Civil Procedure, holding that plaintiffs sufficiently proved that the identified issues warranted
common  resolution. The court reasoned in part, that certification of the proposed issues class would
materially advance the litigation under the Principles of the Law of Aggregate Litigation § 2.02, because
common  resolution of the proposed class issues would either obviate the need for further individual
trials or would fairly and efficiently advance those individual trials by definitively resolving multiple
