5    the Honorable John J. Bennett, Jr., Attorney General of

6    New York, and considered in detail the proposed drafts and

7    comments thereupon.

12          The folloving draft was finally agreed upon and

15   adopted by the Section. -


14          UNIFORM ACT TO SECURE THE ATThNDANCE OF
15          VITNESSES FROM VITHOUT THE STATE IN
16          CRIMINAL CASES

17          Be it enacted.   (Insert here the proper enacting
18          clause for  the State.)

19   SECT'ION U -
20 Witness - as used in this act shall include a person

11   whose  testimony is desired in any proceeding or investigation

22    by a Grand Jury or in a Criminal Action, Prosecution or

23   Proceeding.

24           The v.ord State shall include any Territory of the

25    United States and District of Columbia.

.6    SECTION 1 -
27           SUMMONING WITNESS IN THIS STATE TO TESTIFY IN ANOTHER

28    STATE.  If a judge of a court of record in any state which

29    by its laws has made provision for commanding persons within

30    that state to attend and testify  (in criminal prosecutions)

31    in this state certifies under the seal of such court that

32    there is a criminal prosecution pending in such court, or

33    that agrand   uryinvestigatiorn has commenced or is about

34    to-commence. that a person being within this state is a

35    material witness in such prosecution, or grandxury_

37    investigat;ion, and that his presence will be rekuired

38    for a specified number of days, upon presentation of such

39    certificate to any judge of a court of record in the
