STUDY OF UNIFORM CRIMINAL EXTRADITION ACT


                   Introduction


     In 1926 the Commission on Uniform State Laws

adopted for submission to the several state legislatures

a draft of a Uniform Criminal Extradition Act.  Slight

modifications were subsequently made in this draft. In

1935 the New York State Law Revision Commission

recommended to the Legislature the enactment of the

latest uniform draft, with a few changes, and

supplemented by two proposals made by Professor Robert

S. Stevens, one of the Commissioners on Uniform State

Laws from New York.

     The present report takes into account the

recommendations and study made by the Law Revision

Commission, the comments made by the New York

Commissioners on Uniform State, Laws upon their draft,

and a memorandum offered by Professor Stevens in

support of his proposals.  Tate bill as recommended to

the New York Legislature  in 1935 and the full report

of the Law Revision Co-mission,  incorporating the

texts of the Uniform Act     - the New York

Commissioners'  comments with Professor Stevens'

memorandum, are  appended hereto for reference.

       In addition, there has been restudied the

 constitutionality of Section 6 of the Uniform Act

 (providing for extradition of one who was not in the

 requesting state when the alleged crime was committed);
