ABSTRACT:
In the aftermath of the 9/11 bombings, global state response to terrorism focused on legislative
reform, keeping counter-terror warfare outside of the court and judicial review. This paper argues,
based on comprehensive analysis of the Israeli case, in which national security and counter terror
warfare are under strict judicial scrutiny, that in the post-9/11 era, judicial review over national security
is a major tool in resolving the democratic dilemma in fighting terror.
The reader is invited to review the pioneering research of over 300 court cases and primary
resources analyzing the judicial review over seven major counter terror measures - house demolitions,
land expropriation and the building of a security fence, movement restrictions, targeted killings,
'neighbor procedure', administrative arrests and humanitarian aid for empirical verification of the
argumentation.

Division, Adiri served as the chief negotiator to the Red Cross Delegation to Israel, performing intricate tasks of war zone
liaison missions. He later led the operational coordination team between the Israeli-Egyptian-Jordanian armies, as well as
